Recent practice shows that one of the most frequent claims of the tax authorities during inspections is the exclusion of expenses related to transactions with unreliable counterparties from CIT deductions and VAT offset. On this basis the tax authorities asses significant amount of taxes and corresponding fines and penalties for the entire period of the statute of limitations.
In order to minimize such risks, the concept of due diligence is being developed at the legislative level.
